SMS Messaging Consent for Toll-Free (US and Canada)
By using SMS Scheduler, every SMS recipient must provide explicit consent before receiving any text message.
How Consent Works
SMS Scheduler uses a double opt-in process to ensure every recipient has knowingly and explicitly agreed to receive SMS/text messages:

You add a contact — When you add a contact’s phone number, SMS Scheduler sends them a first SMS message asking for their explicit agreement:
“Reply YES if you consent to receive SMS messages from smsscheduler.com on behalf of [Your Name].”

The recipient replies YES — Only after the recipient replies YES to this message will they begin receiving any scheduled SMS/text messages. If they do not reply YES, no messages will be sent to them.
This means no SMS/text message is ever sent to a recipient without their direct, informed, and explicit consent.
Types of SMS/Text Messages You Will Receive
By consenting (replying YES), recipients agree to receive the following types of SMS/text messages:
- Reminders and notifications about events, tasks, and daily activities (e.g., “Pick up kids at school,” “Take out the dog for a walk”)
- Schedule-based notifications such as weekly personal reminders, appointment alerts, or medication reminders
- Delivery-style notifications for time-sensitive tasks or activities
Message frequency depends on the schedules configured by the sender (daily, weekly, or custom frequency).
How to Opt Out of SMS/Text Messages
Recipients can opt out at any time and stop receiving SMS/text messages by:
- Replying STOP to any message received from the toll-free number — opt-out is processed automatically and immediately
- Contacting support at contact@fabco.tech with your phone number
Once opted out, no further SMS/text messages will be sent to that number. Re-enrollment requires a new explicit consent process.
Carrier Rates and Disclaimers
- Standard SMS and data rates from your mobile carrier may apply
- SMS Scheduler does not charge recipients for receiving messages
- Contact your mobile provider for rate information
SMS Consent Is Separate from Other Agreements
SMS/text message consent is independent from our Terms of Service and Privacy Policy. Agreeing to our Terms of Service or Privacy Policy does not automatically enroll you in SMS/text messaging. SMS consent requires the explicit opt-in process described above.
1. SMS Terms of Service
1.1 Overview
SMS Scheduler (“we,” “us,” “our,” or “the Service”) is a personal reminder service that enables users to schedule and send SMS messages to family members, friends, and colleagues. By using SMS Scheduler, you agree to these SMS Terms.
1.2 Service Description
SMS Scheduler allows you to:
- Schedule SMS reminders for yourself and personal contacts
- Send medication reminders, appointment notifications, and personal task reminders
- Manage a personal contact list with consent verification
- Set up daily, weekly, or custom frequency messages
This is NOT a commercial or cold messaging service. It is designed exclusively for personal or professional communications between individuals with pre-existing relationships.
1.3 Consent and Verification Process
Before Adding a Contact:
You MUST obtain permission from the person before adding their phone number to SMS Scheduler. This means:
- Inform them that you want to send them SMS reminders
- Explain what type of messages they will receive (medication reminders, appointment alerts, etc.)
- Tell them how often they will receive messages (daily, weekly, etc.)
- Inform them that they can opt out at any time by replying STOP
- Notify them that standard SMS and data rates from their mobile carrier may apply
Consent Process:
Once you add a contact’s phone number:
- We will send an SMS to that phone number asking for their explicit consent
- The message will read: “Reply YES if you consent to receive SMS messages from smsscheduler.com on behalf of ‘[Your Name]’.”
- The contact must reply YES to opt in — no messages will be sent until they do
- If they do not reply YES, they will not receive any scheduled messages
Sample Consent Message:
“Reply YES if you consent to receive SMS messages from smsscheduler.com on behalf of ‘John Doe’. Reply STOP anytime to opt out. Msg & data rates may apply.”
1.4 Opt-Out Process
Recipients can stop receiving messages at any time through any of these methods:
Method 1: Reply STOP
- Recipients can reply “STOP” to any message
- Opt-out is processed automatically and immediately
- No further messages will be sent to that number
Method 2: Contact You Directly
- Recipients can ask you to remove them from your contact list
- You MUST remove them immediately upon request
Method 3: Contact Our Support
- Recipients can email contact@fabco.tech with their phone number
- We will mark the number as opted out within 24 hours
Opt-Out Consequences:
- Once opted out, the contact’s status will show as “Opted Out” in your dashboard
- You cannot re-verify this contact unless they explicitly request it and complete verification again
1.5 Message Requirements
All messages sent through SMS Scheduler include:
- Message content - The actual reminder, text message that the user configured.
- Opt-out instructions - How to unsubscribe, automatically added by SMS Scheduler.
1.6 Message Frequency Disclosure
Message frequency depends entirely on the schedules you create:
- Daily reminders: Up to 1 message per day
- Weekly reminders: Up to 1 message per week
- Custom schedules: As configured by you
Recipients are informed of expected frequency during the opt-in conversation with you.
1.7 Pre-Existing Relationship Requirement
SMS Scheduler is designed for personal communication between individuals with established relationships.
✅ Acceptable Relationships:
- Family members: Parents, children, spouses, siblings, grandparents, relatives
- Friends: Personal acquaintances, neighbors, close friends
- Colleagues: Coworkers, team members (for work-related reminders with appropriate permissions)
- Caregivers: Home health aides, personal assistants, medical support staff (with patient consent)
- Household members: Roommates, domestic partners
- Personal relationships: Mentors, tutors, coaches, study partners
❌ NOT Allowed:
- Strangers or people you don’t know personally
- Purchased, rented, or scraped contact lists
- Mass marketing to customers or prospects
- Cold outreach or solicitation
- Any commercial or promotional messaging
- Political campaign messages (requires separate registration)
- Automated debt collection
1.8 Prohibited Activities
You may NOT use SMS Scheduler for:
Illegal Activities:
- Harassment, threats, stalking, or abuse
- Drug trafficking or promotion of illegal substances
- Human trafficking or exploitation
- Money laundering or fraud
- Phishing, malware distribution, or hacking
- Any activity prohibited by local, state, or federal law
High-Risk Content:
- Age-restricted content (alcohol, tobacco, cannabis, gambling) without proper licensing
- High-risk financial services (payday loans, debt collection)
- Political campaigns (requires special A2P registration)
- Sweepstakes, contests, or giveaways without proper disclosures
Commercial Activities:
- Marketing or advertising messages
- Promotional offers or sales
- Business-to-consumer communications (use proper business SMS services instead)
- Affiliate marketing or referral schemes
Abusive Behavior:
- Sending messages without proper consent
- Ignoring opt-out requests
- Spoofing sender identity
- Exceeding reasonable message frequency (spam)
- Sharing accounts with unauthorized users
Violations will result in:
- Warning and account review
- Temporary suspension
- Permanent account termination
- Reporting to authorities if illegal activity is suspected
- Legal action and liability for damages
1.9 TCPA Compliance
Even though SMS Scheduler facilitates personal reminders, you must comply with the Telephone Consumer Protection Act (TCPA):
Your TCPA Responsibilities:
- Obtain Consent: Get permission before sending messages
- Maintain Records: Keep track of when and how consent was obtained (opt-in replies, dates)
- Honor Opt-Outs: Process opt-out requests immediately (within 24 hours maximum)
- No Autodialers for Calls: Do not use automated calling systems without explicit consent
- Respect Do Not Call Registry: For any commercial messages, check the National Do Not Call Registry
TCPA Violations Can Result In:
- Fines up to $500-$1,500 per violation
- Class action lawsuits
- Criminal penalties for willful violations
You Are Liable: SMS Scheduler facilitates messaging but you are responsible for TCPA compliance. We provide tools for consent management and opt-outs, but you must use them properly.
1.10 Carrier and Network Information
Carrier Rates:
- Standard SMS and data rates from your mobile carrier apply
- We do not charge for incoming or outgoing SMS beyond your subscription fee
- Contact your mobile provider for rate information
Supported Carriers:
- All major US carriers (AT&T, T-Mobile, Verizon, etc.) and EU carriers (Orange, T-Mobile, SFR, etc.)
- Most international carriers (availability varies by country)
Delivery Disclaimers:
- We use Twilio as our SMS provider
- We cannot guarantee delivery due to carrier issues, network problems, or device limitations
- Messages may be delayed or filtered by carriers based on content or volume
- We are not responsible for undelivered messages due to:
- Incorrect phone numbers
- Carrier filtering or blocking
- Recipient device issues (phone off, no signal, full inbox)
- Network outages or technical problems
1.11 User Responsibilities - Summary Checklist
Before adding any contact, confirm:
- I know this person (family, friend, or colleague)
- I have asked and received their permission
- I have explained what messages they will receive
- I have told them the message frequency
- I have informed them they can reply STOP to opt out
- I have informed them about standard carrier rates
- They have replied YES to the consent SMS
- I will honor any opt-out requests immediately
- I will only send appropriate, non-commercial messages
- I understand I am responsible for TCPA compliance

2. Terms of Service

Welcome to SMS Scheduler. These Terms of Service (“Terms”) govern your use of smsscheduler.com and related services.
2.1 Agreement to Terms
By creating an account or using SMS Scheduler, you agree to:

2.2 Eligibility

2.4 Subscription and Payment

Billing:
- Subscriptions auto-renew unless cancelled
- You will be charged on your renewal date

Cancellation:

- Cancellation takes effect at the end of the current billing period
- No refunds for partial months (unless required by law)
- After cancellation, scheduled messages will stop sending
Free Trial (if applicable):
- Limited features during trial period
- No credit card required for trial
- Trial converts to paid plan if you subscribe
2.5 Service Modifications
We reserve the right to:
- Modify features or functionality
- Update pricing with 30 days notice
- Add or remove integrations
- Change service limits or quotas
- Discontinue the Service (with 90 days notice)
You will be notified of material changes via email.
2.6 Acceptable Use Policy
You agree to use SMS Scheduler only for:
- Personal, non-commercial reminder messaging
- Communication with people you have a relationship with
- Lawful purposes in compliance with all regulations

2.7 Intellectual Property
Our IP:
- SMS Scheduler, its logo, design, and code are owned by Fabco Tech
- You may not copy, modify, or reverse engineer our Service
- All trademarks and service marks are our property
Your Content:
- You retain ownership of message content you create
- You grant us a limited license to transmit and store your messages for service delivery
- You are responsible for your content (we do not monitor message content)
2.8 Third-Party Services
We integrate with:
- Twilio: SMS delivery and phone number verification
- Stripe: Payment processing
- WorkOS: User authentication
- Google Cloud Platform: Hosting and infrastructure
Each third-party service has its own terms and privacy policies. We are not responsible for third-party service failures or changes.
2.9 Disclaimers
NO MEDICAL ADVICE: SMS Scheduler provides reminder notifications only. We do not provide medical advice, diagnosis, or treatment. Medication reminders are not a substitute for professional medical care. Always consult healthcare professionals for medical decisions.
SERVICE AVAILABILITY: We strive for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for:
- Missed reminders due to technical issues
- Carrier delivery failures
- Internet or network outages
- Force majeure events (natural disasters, war, etc.)
USER CONTENT: You are solely responsible for message content. We do not pre-screen, monitor, or control messages. We are not liable for:
- Inappropriate, offensive, or harmful content you send
- Legal claims arising from your messages
- Disputes with your contacts
AS-IS SERVICE: SMS Scheduler is provided “as is” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
2.10 Limitation of Liability
Maximum Liability: Our total liability to you for any claims arising from or related to SMS Scheduler is limited to the amount you paid us in the 12 months prior to the claim.
Excluded Damages: We are not liable for:
- Indirect, incidental, or consequential damages
- Lost profits, data, or business opportunities
- Punitive or exemplary damages
- Personal injury or property damage
- Third-party claims
Jurisdictional Variations: Some jurisdictions do not allow limitation of liability for personal injury or certain damages. In such cases, our liability is limited to the maximum extent permitted by law.
2.11 Indemnification
You agree to indemnify and hold harmless SMS Scheduler and Fabco Tech from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of TCPA or other telecommunications laws
- Content you send through the Service
- Claims from your contacts regarding unauthorized messages
- Your violation of any third-party rights
2.12 Termination
We May Terminate Your Account If:
- You violate these Terms
- You engage in prohibited activities
- You fail to pay subscription fees
- We receive excessive complaints about your messages
- Required by law or legal process
Upon Termination:
- Your access to the Service ends immediately
- Scheduled messages will stop sending
- Your data will be retained per our Privacy Policy
- No refunds for remaining subscription time (unless required by law)
You May Terminate By:
- Cancelling your subscription in account settings

- Termination takes effect at end of billing period
2.13 Dispute Resolution
Governing Law: These Terms are governed by the laws of [Your State/Country], without regard to conflict of law principles.

- Malware or virus distribution

Harmful Content:
- Hate speech or discrimination
- Violence or threats of violence
- Sexually explicit or pornographic content
- Content exploiting minors
- Deceptive or misleading information
- Impersonation of others
Commercial Activities:
- Marketing or advertising campaigns

- Affiliate marketing
- Lead generation
- Survey solicitation for business purposes

High-Risk Activities:

Technical Abuse:

4.3 Enforcement
